Terms of Service

The service

Foldout lets hospitality operators manage content (hours, menus, enquiry forms and related widgets) from one dashboard and publish it to their existing websites and, where enabled, Google Business Profile. It is provided by Rough (Edinburgh).

Acceptable use

You agree to use Foldout only for lawful purposes and only with content you have the right to publish. You must not misuse the embed, attempt to break tenant isolation, or use the service to send spam or unlawful communications.

Availability

Foldout is offered on a commercially reasonable-effort basis. During the current phase there is no formal uptime SLA. We monitor the service and aim to resolve incidents promptly, but do not guarantee uninterrupted availability.

Data

Our handling of personal data is described in the Privacy Policy. Where we process your website visitors’ personal data on your behalf, the Data Processing Agreement applies and forms part of these terms.

Plans, billing & cancellation

During the design-partner phase we agree the plan, price and rollout scope with you before creating a paid subscription. Where online billing is enabled, Lemon Squeezy is the merchant of record: the checkout states the price, billing interval and applicable taxes before you pay, and Lemon Squeezy issues the transaction documents. Recurring subscriptions renew for the stated billing interval until cancelled. You can cancel through the billing portal or by contacting us; cancellation takes effect at the end of the current paid period unless the checkout terms or applicable law require otherwise.

Liability

To the maximum extent permitted by law, Foldout is provided “as is”, and our aggregate liability arising from the service is limited to the fees paid in the preceding 12 months. We are not liable for indirect or consequential loss. Nothing limits liability that cannot be limited by law.

Termination

You may stop using Foldout and remove the embed at any time. On termination we delete or return your data in line with the Privacy Policy and DPA.

Governing law

These terms are governed by the law of Scotland, and the courts of Scotland have exclusive jurisdiction.
